Executive Summary

Philippine government procurement in 2026 operates under Republic Act No. 12009, the New Government Procurement Act, and its official implementing rules and regulations (IRR). RA 12009 took effect on 13 August 2024; its IRR took effect on 25 February 2025. Implementation is subject to a transition period. Some forms and guidance issued under RA 9184 may continue to be used where replacement materials have not yet been issued. Always check current Government Procurement Policy Board (GPPB) issuances and the bid documents for the particular project.

Defense projects can also involve agency requirements, PhilGEPS notices, end-user documentation, and export controls in the country supplying the equipment. These requirements depend on the item and transaction; no single checklist applies to every AFP or DND purchase.

Which procurement law applies in 2026?

RA 12009 is the current framework. The GPPB describes a transition to full implementation and has issued guidance on the continued use of certain RA 9184 forms and guidelines until corresponding RA 12009 materials are available. The continued use of a form does not make an old RA 9184 section the universal legal basis for a new procurement. Check the current IRR, GPPB circulars, and the project documents.

In July 2026, the GPPB also warned that a “first edition” compilation of the RA 12009 IRR had been withdrawn. Use the GPPB-approved IRR published in the Official Gazette and current GPPB issuances, rather than an unofficial compilation.

What to check before responding to a defense opportunity

  1. Identify the procuring entity and project. Confirm the AFP, DND, or other agency responsible for the purchase, the approved scope, and current bid documents.
  2. Verify the procurement route. Read the mode and eligibility rules in the project documents against RA 12009, its official IRR, and applicable GPPB guidance. Do not assume that a route used under RA 9184 still applies in the same form.
  3. Check PhilGEPS. Confirm the notice, submission method, supplier registration status, and deadlines for this opportunity.
  4. Confirm product and supplier documents. Ask for current manufacturer authorization, specifications, conformity records, and agency-specific documents relevant to the item.
  5. Resolve controlled-item requirements early. Establish the Philippine end user and check whether an end-user certificate, local permit, foreign export licence, or other approval is required. The issuing authority and sequence depend on the product and country of origin.

PhilGEPS and supplier registration

PhilGEPS is the government's procurement portal and a source of notices and supplier information. Registration, documentary requirements, and permitted submission methods should be confirmed against the current portal instructions and the actual bidding documents. Foreign manufacturers should obtain project-specific advice on eligibility and representation rather than assuming every tender requires the same local-distributor arrangement.

End-user certificates and export controls

An end-user certificate may be requested to identify the final recipient and use of controlled goods. Export permission can also be required by the source country. These requirements are distinct from the Philippine procurement route. Suppliers should confirm product classification, end user, licensing authority, and documentary sequence with the relevant agency and export-control adviser before quoting a delivery date.

How BGS can help

Bridge Gate Solutions Corporation can discuss qualified requirements for aircraft spare parts, UAV systems, military medical equipment, and regulated defense supply. A useful first enquiry includes the procuring entity, product category, quantity, intended end user, documentation requirements, and delivery location. Product availability and authorizations are confirmed for each project.
